# Terms of Service — GigaSpeak

## 1. Acceptance

By using the GigaSpeak application ("Service"), you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the Service.

## 2. Service Description

GigaSpeak is a mobile language learning application offering a 60-day curriculum, gamified quizzes, pronunciation practice, and speaking exercises.

**Features:**
- 14 UI languages
- Target languages: English, Spanish (more in future)
- Free: Day 1-4
- Premium: Day 5-60 (subscription required)

## 3. Account

### 3.1 Account Types

- **Anonymous Account:** Name only, no email. Device-bound, not transferable.
- **Email Account:** Anonymous account can be upgraded with email + password. Syncs across devices.

### 3.2 Account Responsibility

- You must be 13 years or older
- Provide accurate information
- Keep your password secret
- You are responsible for all activity on your account

### 3.3 Account Termination

- You: In-app "Delete Account" or contact us
- Us: We may close accounts for serious Terms violations (with notice)

## 4. Subscription and Payment

### 4.1 Premium Subscription

GigaSpeak Premium plans:
- **1 month** (auto-renews)
- **3 months** (auto-renews, discounted)
- **Yearly** (auto-renews, best value)

Prices shown via Google Play Store / Apple App Store in your local currency.

### 4.2 Premium Features

- Access to all 60 days (Day 5-60)
- Bonus modules (Story, Image Quiz, Battle)
- Unlimited audio downloads
- Ad-free (we have no ads anyway)

### 4.3 Payment

- Payments processed by Google Play Store / Apple App Store
- We do **not directly receive payments**
- All fees charged at subscription start or renewal date

### 4.4 Auto-Renewal

- Subscriptions auto-renew
- To cancel: **24 hours before end of current period** via Google/Apple settings
- Premium access continues until end of paid period after cancellation

### 4.5 Refund Policy

- **Google Play:** Refund within 48 hours of purchase
- **Apple:** Subject to Apple refund policies
- We cannot directly refund; please contact the store

### 4.6 Free Trial

- During trial, no charge
- Cancel **24 hours before trial ends** to avoid charge
- Otherwise subscription auto-activates and is charged

## 5. Usage Rules

### 5.1 You may NOT

- ❌ Use the Service for illegal purposes
- ❌ Share Premium with multiple accounts (commercial use)
- ❌ Send automated requests to our servers (bot, scraping)
- ❌ Bypass security mechanisms
- ❌ Reverse engineer, decompile
- ❌ Copy/distribute content (vocabulary, dialogs, audio) without permission
- ❌ Harass, spam, or abuse other users

### 5.2 Violation Consequences

1. Warning (1st violation)
2. Temporary access restriction (repeat)
3. Permanent account closure + no refund (serious/repeat)

## 6. Intellectual Property

### 6.1 Our Rights

All intellectual property in GigaSpeak (code, design, content, audio, characters) belongs to us.

### 6.2 Your Rights

You may use the Service for personal use. No copying, distributing, or derivative works.

### 6.3 Content

Content (word lists, sentences, dialogs) is copyrighted. Audio files generated with AI (OpenAI TTS).

## 7. Disclaimer

GigaSpeak is provided "as is". **No warranty** that:
- Service will operate uninterrupted
- Content will be sufficient for all proficiency levels
- Service is suitable for your specific purposes

**Our liability is limited to the fees paid in the last 12 months.**

## 8. Service Changes

- We may add/remove features
- Change prices (won't affect current period)
- Discontinue Service entirely (30 days notice)

## 9. Limitation of Liability

To the maximum extent permitted by law, GigaSpeak and related parties are not liable for:
- Indirect, special, exemplary, or consequential damages
- Data loss
- Loss of profits or expected revenue

## 10. Governing Law

These Terms are governed by **Turkish law**. Disputes subject to **Istanbul Courts** jurisdiction.

## 11. Changes

Terms may be updated. Important changes notified in-app. Continued use = acceptance of new Terms.
